1. Introduction

Welcome to Tixmondo! By accessing or using our platform, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our services.

2. Definitions

  • "Platform" refers to the Tixmondo website, mobile applications, APIs, and any associated services.
  • "Business/Organizer" refers to any individual, organization, or entity that uses the platform to:
    • Add events, products (e.g., e-tickets, vouchers, accommodations), or other services for sale.
    • Activate membership cards for customers associated with their business.
    • Manage customer interactions, sales, and memberships through the platform.
  • "User" refers to customers or members who use the platform for purchasing tickets, memberships, or other services.
  • "Member" refers to any user who registers for memberships through the platform.
  • "Services" include but are not limited to ticket sales, memberships, cashless payment systems, and other products provided via the platform.

3. Eligibility

You must be at least 18 years old to use our platform. By using the platform, you represent and warrant that you have the legal capacity to enter into these terms.

4. Account Registration

  • Users and Businesses/Organizers must register for an account to access certain features.
  • Account holders are responsible for maintaining the confidentiality of their credentials.
  • The platform reserves the right to suspend or terminate accounts that violate these terms.

5. Payment and Delivery

5.1 Payment Process

  • Payments on Tixmondo are processed exclusively online via Netopia.
  • During the payment process:
    • Users are redirected to the secure Netopia payment gateway.
    • Tixmondo does not store credit card numbers. Instead, for recurrent payments, a token provided by Netopia is used.
    • Once payment is successfully processed, the transaction is verified.
    • If the transaction is approved, the purchased product or service is delivered:
      • For Businesses: Subscriptions or other services are activated.
      • For Customers: E-tickets, vouchers, or accommodations are delivered.

6. Refund Policy

6.1 For Businesses

  • Businesses wishing to cancel their subscription can do so at any time.
  • Subscriptions will remain active until the end of the current billing period (monthly or annual).
  • No further payments will be processed once the subscription period expires.

6.2 For Customers

  • Tixmondo is a distributor of tickets and a reseller of accommodations and, as such, cannot be held responsible for refunding payments made for access tickets or accommodations.
  • However, Tixmondo will make every effort to facilitate refunds from the respective organizers or hotels in the event of cancellations.
  • Specific Refund Terms:
    • Refunds for electronic tickets or hotel bookings are generally exempt from mandatory returns under OUG 34/2014, Art. 16.
    • Refunds are only applicable in cases of event or booking cancellations, or changes to dates or locations.
    • Non-refundable items include delivery fees, payment method fees, or other additional costs.

7. Memberships

7.1 Membership Features

  • Businesses/Organizers may offer memberships to their customers through the platform. These memberships can be free or paid, with benefits determined by the Business/Organizer.
  • Benefits may include discounts, access to exclusive content, or loyalty programs.

7.2 Membership Activation

Memberships are linked to unique customer profiles and can be used for event access, discounts, or other benefits.

7.3 Data Management

Data collected during membership registration is securely shared with the Business/Organizer in compliance with Tixmondo’s Privacy Policy.

8. Cashless Payments

8.1 How It Works

  • Tixmondo facilitates cashless payment systems, including NFC cards and digital wallets.
  • Customers can charge NFC cards online or at designated stations.

8.2 Refund Policy

Refunds for unused NFC card credit are at the discretion of the Business/Organizer.

8.3 Security

Advanced encryption is used to protect all transactions.

10. User Conduct

10.1 Prohibited Activities

  • Uploading fraudulent or illegal content.
  • Manipulating the platform for unauthorized gains.

11. Intellectual Property

All content, branding, and platform elements are the exclusive property of Tixmondo or its licensors.

12. Limitation of Liability

Tixmondo is not liable for event cancellations, booking issues, or financial losses arising from technical disruptions.

13. Dispute Resolution

13.1 Negotiation

Contact support[at]tixmondo.com to initiate dispute resolution. If unresolved, disputes may be resolved through mediation or arbitration.
